Terms of sale

1. MYSTERIUS.COM represented by the S.P.R.L. ELECNET having its registered office at 20 Grand-Place, 6001 MARCINELLE in BELGIUM and registered on the trade registry under the number 195.557.

2. Unless expressly agreed otherwise in writing between the parties, the relations between MYSTERIUS.COM and its clients shall be subject to these terms of sale which are acknowledged and accepted by the client, notwithstanding any contradictions which may exist with the client’s own general or special terms of business. The fact that the client has not received these terms of sale in his mother tongue shall in no way exempt the client from their application..

The terms of sale and the site of MYSTERIUS.COM, as well as its content, although they may be consulted worldwide, have been prepared and formatted strictly for clients located in Belgium.
Clients established abroad should be aware that certain provisions in the terms of sale cannot be applied to them or be relied upon by them. However, that fact in no way invalidates the terms of sale as a whole.

MYSTERIUS.COM reserves the right, when it deems it necessary, to change or amend its terms of sale without informing the clients personally of such changes or amendments and clients will in no circumstances be entitled to claim compensation in respect of any such changes or amendments. It is therefore the client’s responsibility to examine regularly whether any changes or amendments have been made.

3. MYSTERIUS.COM delivers throughout the world. Transportation costs are to be paid by the client in accordance with the rates indicated on the site. Goods are always shipped at the client’s risk.

4. Offers and price lists are established and transmitted to clients without any obligation.
In this regard MYSTERIUS.COM shall only have an obligation to a client after it has confirmation an order to the client by e-mail or from the time when MYSTERIUS.COM has started to implement the contract.

5. MYSTERIUS.COM informs its clients insofar as it is necessary that the MYSTERIUS.COM site may contain links or hyperlinks with other sites. (The "linked sites").

MYSTERIUS.COM disclaims all responsibility concerning the content appearing on a linked site or for any product or service listed by the linked site. The linked sites are managed by an operator independent from MYSTERIUS.COM.

6. Orders may only be placed on the MYSTERIUS.COM. site or by telephone or fax or by post.

Payments for orders are to be made exclusively by credit cards, VISA,MASTERCARD or AMERICAN EXPRESS, by payment on delivery, by mailing a cheque, by bank transfer or by international money order.

7.MYSTERIUS.COM acts as an intermediary and therefore the only guarantee provided in respect of the goods delivered is that of the manufacturer. In any event, and subject to the conditions of any such guarantee, the role of MYSTERIUS.COM will be restricted to replacing defective products or to refunding the price paid without the client being entitled to claim damages. MYSTERIUS.COM shall in no circumstances be liable for the non-performance by its supplier of its obligations under its guarantee, in particular in the event of the supplier’s bankruptcy.

8. Notwithstanding article 1583 CC, MYSTERIUS.COM shall continue to own the products sold until all amounts due by the client , whether by way of principal and/or interest and/or any lump indemnity, have been paid in full. The client hereby assigns to the seller all amounts which it may be owed by third parties. The client releases MYSTERIUS.COM from any notification formalities and agrees to bear any costs which may be incurred in this connection. In addition, the client authorises MYSTERIUS.COM to recover the material at any time, wherever it may be located. Insofar as it may be necessary, the client authorises MYSTERIUS.COM to access the premises it occupies.

9. MYSTERIUS.COM accepts no liability for any loss or for any material or other damages, of whatever nature, that the client or a third party pay suffer as a result of notably the transport, delivery, storage, placing, use or functioning of the products delivered. This covers notably, but is not restricted to, damages affecting the material, premises, data and software belonging to the client or to a third party, operating losses and material damage.

10.The sale and delivery of goods by MYSTERIUS.COM include no transfer of the relevant intellectual property rights. These rights remain the property of the supplier of MYSTERIUS.COM and the client undertakes not to infringe those rights. MYSTERIUS.COM declares that to the best of its knowledge, the products delivered contain no infringement of the intellectual property rights of third parties. MYSTERIUS.COM shall in no circumstances be liable with regard to any dispute which may arise as to the ownership, exploitation or infringement of the intellectual property rights attached to the items delivered.

11. In the framework of the distance selling of goods to consumers within the scope of application of the law of 14 July 1991, amended by the law of 25 May 1999, the consumer has the right to inform the seller that he wishes to withdraw from the purchase, without any penalty and without being obliged to give any reason, within seven working days running from the day following the delivery day. This cancellation of an order is however only valid on condition that the consumer has notified his intention to the seller by registered letter and that the goods are still in their original unopened packaging, that they have not been used and are ready for sale. In the event that the consumer decides to avail himself of this option, then he shall return the goods to MYSTERIUS.COM, by whatever means, at his own risk and at his own cost.

"Consumer" shall be understood to mean any natural or legal person who acquires or uses for non-professional purposes products or services placed on the market.

Consequently, this clause does not extend to natural or legal persons that acquire MYSTERIUS. COM products for professional purposes.

12. The parties agree to accept, in the framework of their relations, electronic means of proof (by way of example: E-mail, backups, ...).

13. By virtue of placing an order on the MYSTERIUS.COM site, the client explicitly authorises MYSTERIUS.COM to process his personal data and to use such data for the company’s internal management purposes. "The company’s internal management purposes" shall be understood to mean the processing of orders, client administration, including the administration of deliveries, services and billing, monitoring the client’s solvency as well as marketing and personalised publicity.

For more detailed information, the client is invited to consult the public register updated by the Commission for the Protection of Personal Data.

14. Our prices are established in accordance with the rates applying on the day of delivery or of shipment, but may be amended without prior notice.

15. If one of the conditions of these terms of sale should be declared invalid or inapplicable, the other conditions hereof shall remain in full force and that condition will be applicable to the extent permitted by law.

16. MYSTERIUS.COM disclaims all responsibility concerning any vile use or unhealthy interpretation of these articles and/or products. Everything contained in our virtual catalogue presented on our site in no way replaces drugs nor medicine and is in no way contradictory with any religion, philosophy and other beliefs of whatever nature. No product is intended for use as food.

17. Pursuant to the Belgian law of 22 March 1886 and international agreements on intellectual property right, only the authors have the right to reproduce their works or to authorise the reproduction of such works in whatever way and in whatever form.
Consequently, any reproduction of any extract whatsoever of the Mysterius.com. site is prohibited Any infringement of this rule shall be considered as an act of unfair competition and may lead to legal proceedings under the criminal code.

18. The presentation of our books and our articles is not contractually binding in nature and certain products may be shown in a reduced or enlarged format in relation to the actual format.

19. Any disputes concerning the validity, conclusion, performance or interpretation of the contract or of these terms of sale shall be governed strictly in accordance with Belgian law and shall be subject to the exclusive jurisdiction of the courts of CHARLEROI.
